Terms of service

These terms govern the use of witness, provided by Jobbin AB ("we", "us"), a Swedish limited company with org. no. 556893-2452, Stockholmsvägen 60a, 181 42 Lidingö, Sweden. They apply between us and the organisation that creates projects and pays for them ("you", "the customer"). witness is sold to businesses; by signing in to the console or paying for a plan you confirm that you act for a business and not as a consumer.

1. What the service is

witness is a hosted record of findings and decisions: what is wrong, what should change, and what has been decided — recorded by the people working on a project and by any AI agents they use. A project is created by you in the console and reached by two links: a view link, which reads and comments, and an edit link, which also changes the project's cards and prose. A browser opening a link gets the application; anything else — a script, a coding agent — gets the project's working rules as a document. Two plans exist. Free is one active project with every feature. Team, at €29 per month per organisation excluding VAT, is unlimited projects. The current prices and what each plan includes are at witness.nu/pricing.

2. Accounts and links

Only the person who manages the organisation and its subscription has an account, in the console. Sign-in is provided by Clerk (see sub-processors). You are responsible for keeping that account's credentials to yourself.

Everyone else uses links. A link is a credential: whoever holds it can do what the link allows, without signing in. You decide who receives a link, and you are responsible for what is done with the links you hand out. If a link is exposed, rotate it in the console or through the admin interface; the old links stop working at once.

3. Your content

Everything you and the people you give links to put into a project — cards, comments, prose, images — is yours. You grant us the right to store, process and transmit it only as needed to provide the service to you. We do not read your projects except to operate the service, to investigate a suspected breach of these terms, or when you ask us to.

You are responsible for having the right to put the content there, and for it not being unlawful, infringing or harmful. Images are limited in size and number per card; the limits are stated in each project's working rules.

Where your projects contain personal data — the names of the people who write in them, for instance — we process it on your behalf under the data processing agreement, which is part of these terms.

4. Acceptable use

You may not use witness to store or distribute unlawful content, to attack or probe the service or other customers' projects, to guess links, or to place load on it that is out of proportion to ordinary use. The service enforces per-address budgets on the open surfaces; those are a floor on what we tolerate, not a licence to run up to them.

5. Fees and payment

Team is billed per organisation, monthly or annually in advance, by card through Stripe. Prices exclude VAT, which is calculated at checkout for your country; a business with a valid VAT number in another EU member state is invoiced under reverse charge. Invoices and receipts are in the billing portal, reachable from the console.

If a payment fails, we retry it and tell you. Nothing is switched off while a payment is being retried. If a subscription is cancelled or a payment ultimately fails, the organisation returns to the Free plan at the end of the period already paid for. Fees for a period already started are not refunded, unless the law says otherwise.

We may change prices with at least thirty days' notice by email to the account holder. A change applies from the next billing period after the notice period.

6. Availability and support

We run witness with care but without a guaranteed uptime. We may take the service down briefly for maintenance and will try to do so at times of low use. Support is by email at support@witness.nu, answered by a person, on Swedish working days.

7. Changes to the service and to these terms

We may improve or change the service. Where a change removes something you rely on, we will give thirty days' notice by email. We may also change these terms; a material change is announced thirty days ahead, and if you do not accept it you may end the agreement before it takes effect. Continued use after that date is acceptance.

8. Intellectual property

The service, its software and its documentation are ours or our licensors'. You get a non-exclusive, non-transferable right to use the service for the term of the agreement. Feedback you give us about the service may be used by us without obligation.

9. Warranties and liability

The service is provided as it is. We do not warrant that it is uninterrupted or free of errors, or that it fits a particular purpose.

To the extent the law allows, our total liability under this agreement, for all claims in any twelve-month period, is limited to the fees you paid us in that period. We are not liable for indirect loss, lost profit, or loss of data that you could have exported and did not. Nothing in these terms limits liability for gross negligence, intent, or where the law forbids limitation.

10. Term and termination

The agreement runs until you end it — by deleting your projects and your organisation in the console, or by writing to us — or until we end it. We may end the agreement on thirty days' notice, or immediately if you breach these terms in a way that harms the service or others.

When the agreement ends, your projects remain exportable for thirty days, after which they are deleted, together with their images. Backups are removed within a further thirty days. The privacy policy describes what we keep after that and why.

11. Governing law and disputes

Swedish law applies, without its conflict-of-law rules. Disputes are settled by the Swedish courts, with the district court for our registered seat as the court of first instance.
